Terms & Conditions

AutoFlow Technologies Private Limited  ·  AutoLync MSME Platform

Please read these Terms and Conditions carefully before using the AutoLync MSME platform operated by AutoFlow Technologies Private Limited. By registering an account or accessing any part of the platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.

A. Description of Service

AutoFlow Technologies Private Limited provides users with access to a rich collection of resources and services, including various communications tools, business management features, and other services (collectively, the "Service"). The Service, including any updates, enhancements, new features, and/or the addition of any new web properties, is subject to these Terms and Conditions.

B. User Eligibility & Account Registration

The Service is available only to persons who can form legally binding contracts under applicable law. The Service is not available to persons under the age of 18 or to persons who have previously been removed or debarred from using the Service.

If you are registering as a business entity, you represent that you have the authority to bind such entity to these Terms and Conditions.

AutoFlow Technologies Private Limited reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.

You are solely responsible for all content and material that you upload, post, email, or otherwise transmit via the Service. AutoFlow Technologies Private Limited does not control and has no obligation to monitor third-party content posted on the Service. However, AutoFlow Technologies Private Limited reserves the right to review materials posted and to remove any materials it deems, in its sole discretion, to be unlawful, offensive, or otherwise in violation of these Terms.

AutoFlow Technologies Private Limited reserves the right to investigate and take appropriate action against anyone who, in its sole discretion, violates these Terms, including reporting such activity to law enforcement.

E. General Practices Regarding Use and Storage

You acknowledge that AutoFlow Technologies Private Limited may establish general practices and limits concerning use of the Service, including maximum disk space allocated, maximum number of times and duration you may access the Service in a given period, and maximum number of messages sent or received.

You agree that AutoFlow Technologies Private Limited has no responsibility or liability for the deletion, corruption, or failure to store any messages and/or other communications or content maintained or transmitted by the Service. You acknowledge that AutoFlow Technologies Private Limited reserves the right to log off accounts that are inactive for an extended period of time.

AutoFlow Technologies Private Limited reserves the right to modify these general practices and limits at any time, at its sole discretion, with or without notice.

F. Content & Your Data

You retain ownership of all business data, employee data, and content you upload to AutoLync MSME ("Your Data"). By using the platform you grant AutoFlow Technologies Private Limited a limited, non-exclusive licence to store, process, and display Your Data solely for the purpose of providing the Service to you.

AutoFlow Technologies Private Limited does not claim ownership of the content you submit or make available through the Service. However, with respect to content you submit or make available for inclusion on publicly accessible areas of the Service, you grant AutoFlow Technologies Private Limited a world-wide, royalty-free, non-exclusive licence to reproduce, modify, adapt, and publish such content for the purposes of displaying and distributing the Service.

AutoFlow Technologies Private Limited takes no responsibility and assumes no liability for any user content posted or submitted, or any loss or damage resulting therefrom.

G. Intellectual Property Rights

All software, designs, trademarks, service marks, logos, and other content comprising the AutoLync MSME platform — excluding Your Data — are the exclusive intellectual property of AutoFlow Technologies Private Limited or its licensors and are protected by applicable Indian and international intellectual property laws.

Nothing in these Terms transfers any intellectual property rights to you. You may not copy, modify, distribute, sell, reverse-engineer, decompile, or create derivative works from our platform without prior written permission from AutoFlow Technologies Private Limited.

H. Privacy Policy

Registration data and certain other information about you are subject to our Privacy Policy. You understand that through your use of the Service you consent to the collection and use of this information, including the transfer of this information within India and/or other countries for storage, processing, and use by AutoFlow Technologies Private Limited. As part of providing the Service, AutoFlow Technologies Private Limited may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Service and you may not opt out of receiving them.

I. Representations & Warranties

You represent and warrant that:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AUTOFLOW TECHNOLOGIES PRIVATE LIMITED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

J. Indemnification & Limitation of Liability

You agree to indemnify and hold AutoFlow Technologies Private Limited, and its subsidiaries, affiliates, officers, agents, co-branders, partners, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit, or make available through the Service, your use of the Service, your connection to the Service, your violation of these Terms, or your violation of any rights of another person or entity.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOFLOW TECHNOLOGIES PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE — INCLUDING LOSS OF DATA, REVENUE, OR PROFITS.

Our total cumulative liability to you for any claim arising from these Terms or use of the platform shall not exceed the amount paid by you (if any) to AutoFlow Technologies Private Limited in the three months preceding the claim.

K. Modification & Termination of Service

AutoFlow Technologies Private Limited reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that AutoFlow Technologies Private Limited shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Either party may terminate the use of the platform at any time. AutoFlow Technologies Private Limited reserves the right to suspend or terminate accounts that violate these Terms, without prior notice. Upon termination, you may request export of Your Data within 30 days. After that period, data may be deleted in accordance with our data retention policies.

AutoFlow Technologies Private Limited reserves the right to modify these Terms and Conditions at any time. We will notify you of material changes by updating this page and, where appropriate, by sending an email notification. Continued use of the platform after changes take effect constitutes your acceptance of the revised Terms.

L. Choice of Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.

Before initiating any legal proceedings, both parties agree to attempt good-faith resolution through written notice and negotiation for a period of 30 days.
